Haikou Intermediate People's Court hears criminal case of environmental pollution

In the morning of January 8th, Haikou Intermediate People's Court opened a trial in accordance with the law. The defendant Chen Mouhua and other 40 people who were prosecuted by the Haikou City People's Procuratorate committed a crime of environmental pollution.
 
In this public hearing, the Haikou Intermediate People's Court consists of three judges to hear the case. Three prosecutors of the Municipal Procuratorate appeared in court to support public prosecution. 47 defenders appeared before the court.
 
The public prosecution charged: It was found that from December 2017 to October 2018, five people including Liang Mouqin, Chen Mouhua, Huang Mouqin, Liao Mouhuan, Zeng Moujian (handled in another case) have invested in the stock. Changan District, Jinjiang Town, Chengmai County, Hainan Province, and Shifu District, Wenru Town illegally opened a dismantling plant and a smelting plant for waste lead-acid batteries, and hired the defendant to support a certain person, Yao Mokang, Qi through Li Mouquan and Xue Moopeng. Mo Quan, Xing Moorui, Zhou Mou Kui, Liu Mou Li, Yu Mou Gang, Zhi Mou Ming, Guan Mou Gui, Nan Mou Ming, Zhang Moomin, Li Mouliang, Zhang Mouqi, Dong Mouli, etc. Solution and smelt. During the period, Chen Mouhua, Liao Mouhuan and others purchased a total of about 891 tons of waste lead batteries, and produced and sold about 422 tons of lead ingots and flue ash, valued at about 6.43 million yuan.
 
After replying to the opinion on the identification of hazardous waste issued by the Chengmai County Ecological Environmental Protection Bureau, it was determined that the waste lead battery has not been dismantled, the battery cover, battery plastic shell, and lead ingot produced by dismantling the waste battery after dismantling, Flue ash and so on are all hazardous waste. The South China Institute of Environmental Sciences of the Ministry of Ecology and Environment conducted an appraisal of environmental damage caused by Chen Mouhua and others during the period from May 2018 to March 2019, and confirmed the fact that the environment was polluted. At the same time, it was confirmed that the total amount of environmental damage in this illegal disposal of lead-acid battery environmental pollution case was 721,000 yuan, of which the emergency disposal cost was 212.6768 million yuan, and the ecological environment damage cost was 502,000 yuan.
 
The public prosecution agency believes that the defendant Chen Mouhua and others violated state regulations, illegally disposed of hazardous waste, and seriously polluted the environment. Their actions constituted environmental pollution crimes, and they should be investigated for criminal responsibility for environmental pollution crimes.
 
Due to the large number of people involved and the complexity of the case, the trial period is expected to last 3 days.
